Appeals Court Affirms Summary Judgment in Will Contest for H&B Attorneys Joe Bierwirth and Ryan McManus

On April 1, 2020, the Massachusetts Appeals Court affirmed an award of summary judgment in a will contest litigated by Joe Bierwirth and Ryan McManus. Joe and Ryan represented the decedent’s estate, and defended his last will against a challenge alleging lack of capacity, undue influence and fraud. In a thirteen page decision, the Appeals Court upheld the Fiduciary Litigation Session in finding that the will was valid and fully expressed the decedent’s last wishes. As a result, substantial business and real estate interests were protected for Joe and Ryan’s client.
