Additional COVID Relief for Nonprofits

By Brad Bedingfield, Eleanor Evans, Keirsa Johnson, Meaghan Borys, Leni Nulsen and Dylan O'Sullivan*

1/12/2021 victories of Rafael Warnock and Jon Ossoff in the January 5, 2021 Georgia runoff elections, and the resulting Democratic control over the House, the Senate, and the White House, could mean significant changes to laws affecting nonprofit organizations. In the meantime, on December 27, 2020, President Trump signed the 5,500 page Consolidated Appropriations Act of 2021 (the Act). The Act includes a number of provisions of interest to our nonprofit clients, including the following:

  • Support for hospitals and vaccine access
  • Additional Higher Education Emergency Relief Fund (HEERF) support for colleges and universities
  • Shuttered venue operator grants
  • Economic Injury Disaster Loans (EIDL)
  • Employee retention tax credit
  • Paid sick and family leave credits
  • Unemployment benefit reimbursements
  • Payroll tax repayment
  • Charitable giving incentives

*Leni B. Nulsen is admitted to the bar in New York. She is not admitted in Massachusetts.

*Dylan S. O’Sullivan is a third year law student at Northeastern University School of Law and is not a practicing attorney.
