Eleanor Evans to Discuss Hendrickson Decision and Nonprofit Dissolutions in Massachusetts

Eleanor Evans will co-present Nonprofit Dissolutions in Massachusetts: A Discussion of the Hendrickson Case at the Boston Bar Association on February 24, 2026.

The program will examine the Supreme Judicial Court’s October 2025 interlocutory decision in The Stephen J. Hendrickson Foundation, Inc. v. Attorney General, which clarified the legal standards governing voluntary dissolution of a Massachusetts charity with remaining assets under Massachusetts General Laws Chapter 180.

In Hendrickson, the Court authorized the transfer of remaining charitable assets to a newly formed out-of-state foundation over the Attorney General’s objection. The discussion will cover the statutory framework for voluntary dissolution of Massachusetts nonprofit organizations, the Court’s reasoning in Hendrickson, and the implications for future dissolution proceedings.
