ENVIRONMENTAL, ZONING & OTHER REAL ESTATE MATTERS
Because real estate is a limited resource, issues involving resolution of
competing real property interests and the use and development of real estate are
frequently hotly contested. The Litigation Group has considerable experience in all
types of real estate and land use litigation, including disputes involving specific
performance of real estate contracts and leases, disputes over title to land,
easements and rights of access, shore rights and beach rights, disputes involving
appeals from grants or denials of special permits and variances under local zoning
ordinances and bylaws and approvals under the Subdivision Control Law, disputes
involving wetlands delineation and wetland permitting, and disputes with building
inspectors and numerous other environmental and land use matters.
Members of the real estate group have extensive experience in these substantive
areas and in resolving and trying these cases in the Land Court and Superior Court.
