Legal Counsel : Business Law

Employment Law

Here's an area of the law that's a lot like life.  The complex state and federal laws governing the rights of employees change constantly and, often, abruptly.

This constant change creates new rights and imposes new obligations.  It makes sense that employers would rely on experienced legal counsel to keep from running afoul of the law.

Our employment lawyers handle the sophisticated and sometimes difficult issues that arise, including:

  • Recent developments in HR regulations including Family and Medical Leave Act, The Fair Labor Standards Act, ADA and discrimination statutes, WARN, HIPPA and COBRA
  • Legal issues surrounding hiring, performance and discipline,  termination and lay-offs
  • Drafting and review of employment-related documents including HR policies, nonqualified compensation and benefit plans
  • Drafting and review of employee agreements for employment and consulting, noncompetition and nonsolicitation, nondisclosure and confidentiality and severance
  • Employment plans and programs
  • Training on employment practices and policies including sexual harassment and discrimination prevention, compliance with Family Medical Leave Act, leaves of absence, wage and hour issues and executive compensation
  • Dispute resolution and litigation

A Word About Litigation

Our intention is to help clients avoid litigation.  If our client ends up in court or before an administrative body, however, our trial lawyers have prevailed in a variety of forums.  These include state and federal courts, the Massachusetts Commission Against Discrimination, the Equal Employment Opportunity Commission and the Department of Health and Human Services.  We also regularly represent leading employers in arbitrations and mediations.
