Practice Focus

Shana E. Maldonado helps clients in the areas of probate, trust, real property, business litigation and dispute resolution.  She represents trust and estate fiduciaries and beneficiaries in court proceedings and contested matters and regularly appears on behalf of clients in the Probate Court, Land Court and Superior Court.

Representative Experience

  • Represented beneficiaries and executors/administrators of wills in will contests
  • Represented trustees in breach of fiduciary suits
  • Represented landowners in cases seeking review of local governing authorities' decisions concerning special permits, Title 5 septic system permits and wetlands permits
  • Represented homeowners claiming and defending against adverse possession and prescriptive easement claims
  • Represented former homeowner in defending against negligence claims by new owners arising from damage discovered after sale was completed
  • Represented private equity firm in defense of a tort claim arising from an acquired company's business operations.

Activities and Publications

Shana is an active member of the Boston Bar and Massachusetts Bar Associations.  She has co-authored materials for both including:

  • Chapter on boundary disputes and adverse possession in the MCLE publication Neighbor and Nuisance Law
  • "Case Summary: Gates v. Reilly, 453 Mass. 460 (2009)," appearing in the BBA's Trust & Estates 2009 Spring Newsletter.
